Forum Issued arrest warrant

Taking a strict action against a vehicle owner for not complying with the order, the District Consumer Disputes Redressal Forum (DCRF) issued warrant for his One month imprisonment.
According to information available, one Asha Devi registered owner of a vehicle, was accused in a complaint filed with DCRF by one Nageshwari Devi for refund of sale consideration and repair charges of vehicle.
At that time, the DCRF passed an order in favor of complainant, but the convicted person did not comply with the orders of the DCRF issued on Nov, 2009, wherein the accused was ordered to refund a sum of Rs. 1,25,000, being the sale consideration of vehicle paid by the complainant and a sum of Rs. 41310 paid by him to the accused for repair charges of the vehicle. The convicted person was also asked to pay the amount for causing mental tension and cost of complaint filed.
On receipt of complaint, a notice was also issued to the opposite party but the convicted person did not appear before the forum and as such, ex-parte proceeding was taken up against him.
In the details of the order issued by the quorum of the forum mentioned that “this is a glaring example of disobeying of order. The accused was arrested twice during the proceedings and she had made statement to make the payment. But she has hoodwinked the forum by not making the payment as promised by her. This shows she has willfully and intentionally failed to comply the order of this forum”.
“Taking into consideration all pros and cons, facts and circumstances and the adamant attitude of the opposite party, we proceed to sentence the opposite party to undergo simple imprisonment for one month and also to pay a fine of Rs. 1000. In case of default, the opposite party shall further undergo simple imprisonment for a period of seven days,” the order mentioned.
Confirming the facts, the president of DCRF, Rajeev Bhardwaj said, “ We have issued arrest warrant on the guilty vehicle owner to the police to be returnable for 9th August 2011”.
