Consumer Forum Mandi also directed Bank to pay 5000 as compensation and 3000 as litigation cost

District Consumer Redressal Forum Mandi, has directed State Bank of India Branch of Jaisinghpur in District Kangra to pay claim amount of Rupees One lac sixty three thousands in favour of the Consumer. Forum further directed Bank to pay Rs. 5000 as compensation for the harassment faced by the complainant due to the deficiency in service on the part of Bank and Rs. 3000 as cost of the litigation.
President, District Consumer Forum Rajeev Bhardwaj and member Rama Verma allowing the complaint of Anil Kumar resident of village Sandhol of Tehsil Sarkaghat of District Mandi directed the Bank concerned to pay the claim amount with interest @ 9% per anum. As per the compliant filed through advocate Vikas Chander Verma the complainant started his business at Jaisinghpur under the name and style of ‘ Bandana Cloth Home’ by raising loan from the Bank. The stock in his shop was insured with the New India Assurance Company by the Bank. In the mean time the complainant shifted his business to Sandhol and it was duly intimated to the Bank.
On 30th May 2008 the shop of the complainant was destroyed in the fire. The Police and Bank were informed by the complainant. The insurance company had deputed surveyor to assess the loss. The complainant had supplied all the relevant documents to the insurance but the loss was not settled by the company and therefore complainant had filed the present complaint alleging the deficiency in service.
The forum come to the conclusion that it was the responsibility of the Bank to inform the insurance regarding the change of place of business of the complainant. It is not proved that the Bank had informed the insurance company about the said change. This inaction and negligence has put the complainant in loss. Accordingly, forum hold the Bank liable to indemnify the complainant.
